"Hindustan Times" : After legal setback, Trump says considering ‘brand new’ immigration order

US President Donald Trump said Friday he is considering drafting a new order to ban migrants from majority-Muslim nations after his initial decree fell afoul of the law. An appellate court decided unanimously on Thursday to maintain a block on Trump's order put in place by a lower court judge a week before. The debacle has raised questions about the competence of Trump's White House in working through the practical and legal implications of the order. We also have a lot of other options, including just filing a brand new order," he said, adding that any action would not come before next week. The statement represents an embarrassing climbdown for Trump, who has insisted that the order was well drafted and who has nevertheless vowed to fight on in the courts.

The 9th Circuit judges indicated that some of the administration's proposed concessions — which presumably could turn into rewrites — don't go far enough. White House and Justice Department officials began mulling several options as new Attorney General Jeff Sessions was briefed on the matter. Meanwhile, a 9th Circuit judge, without prompting, called for a vote to determine whether the entire court should rehear the case. They could ask the Supreme Court or the full 9th Circuit to intervene immediately. On Friday he posted on Twitter a quote from a Lawfare article, which noted that the 9th Circuit judges had not cited in their opinion the section of the Immigration and Nationality Act that gives him such powers.

The Justice Department is weighing its options, which also include appealing to a broader panel of judges or the Supreme Court. Josh Blackman, a professor at South Texas College of Law in Houston, said the "million-dollar question" is whether the Trump administration would appeal to the Supreme Court. Although President Trump said he is convinced that his travel ban will eventually win in court, he said Friday that he is considering crafting a "brand new order." "I have no doubt that we'll win that particular case," Trump said at the White House, during a press conference alongside visiting Japanese Prime Minister Shinzo Abe. In that case, his administration could continue a legal fight for his first order all while crafting another.
